TERMS OF USE
Welcome to Felt. The aim of the following terms and conditions is to help ensure a safe and reliable marketplace for buyers and sellers. All enquiries regarding any of our terms are welcome.
Acceptance of terms
By registering with Felt and using the Felt website you accept the following terms and conditions. If you do not accept these terms and conditions, you must refrain from using the services offered by Felt.
Alteration of terms
Felt Ltd reserves the right to alter these Terms of Use at any time. Amended terms and conditions posted on the Felt website will be effective immediately. You are responsible for ensuring you are familiar with the latest terms and conditions. Continuing to use the website represents your acceptance of the terms and conditions as amended.
Terminology
In these terms and conditions, the following expressions have the meanings set out:
'we', 'us' and 'our' refers to Felt Limited;
'you' and 'your' refers to you;
'item', 'items' means goods that may be bought or sold through Felt;
'member' means a registered member of Felt;
'account' means a Felt account;
'services' means any one or more of the services offered by Felt, including sale or purchase of items and message facilities;
'website' means the Felt website;
'listing' means a listing for an item on the website;
'seller' refers to any person placing a listing on Felt;
'buyer' refers to any person purchasing an item listed on Felt.
GENERAL TERMS
Violation of these terms will result in the termination of your account.
1. You must be older than 18 or under the supervision of a legal guardian to register on Felt. You or your legal guardian are responsible for any activity that occurs under your username.
2. You are responsible for keeping your account details and password secret and secure.
3. You must not abuse or harass other members of Felt.
4. You must not send unwanted messages or email to any Felt members.
5. You are responsible for any data, text, information, screen names, graphics and photos that you submit on the Felt website.
6. You must not damage or interfere with the website, or any network or system underlying or connected to it, or attempt to do so.
7. You may not use Felt for illegal or unauthorised purposes. By registering with Felt you agree to comply with all local laws regarding online conduct and acceptable content.
8. You shall not list contact details, including your email address and phone number, within listings or messages posted on Felt, or in your member profile.
9. You must not arrange a transaction outside of the Felt process or otherwise seek to avoid sales commission on Felt.
10. All listings must state prices in New Zealand dollars with GST included. All tax obligations are the responsibility of the seller and/or the buyer.
CONDITIONS
1. Felt Ltd provides a venue to enable members to buy and sell handmade items. Felt is not involved in any part of the sale of items, other than providing an online venue for members. Upon the sale of an item, the contract is formed between the buyer and the seller directly.
2. Felt Ltd takes no responsibility or liability for any misconduct of any of its members. All contact between you and other members, including any transactions or messages, is entirely at your own risk.
3. Felt takes no responsibility for the ownership, content, quality or legality of items sold or listed on the Website, or the accuracy of listings or ability of members to complete a transaction.
3. Felt reserves the right to remove content (including items and item descriptions) and accounts containing content that Felt considers to be unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or any of Felt’s terms and policy documents.
4. Felt Ltd reserves the right to alter or terminate Felt services for any reason, without notice at any time.
5. Felt Ltd reserves the right to refuse service to anyone for any reason at any time.
SELLER RESPONSIBILITIES
1. Your listings must be accurate and complete, and include all relevant information about the terms of sale, payment terms, shipping methods and shipping costs. All items must be listed in an appropriate category.
2. You will only place listings for handmade items that are to be sold. You will not list items that you are not legally entitled to sell or that are not in your possession. You must not place multiple listings for a single item.
3. You must not list anything that is illegal, offensive (including anything of a defamatory, pornographic, or racially or ethnically objectionable nature), stolen, or unsafe, anything which infringes copyright or other intellectual property rights or any item of which the sale is prohibited by, or violates any, law.
4. You must hold the copyright for any text and images you include in your listings.
5. Unique items listed on Felt should not be advertised elsewhere. Listings must be withdrawn if the item is no longer available. The listing fee is non-refundable.
6. Your listing may contain a URL for a website that contains further information on you or the item you have listed. This website must not offer any items for sale, or contain contact details.
7. Your first five listings are screened for content. Felt reserves the right to refuse any listing that it deems unsuitable.
8. You must send the listed item promptly to the buyer on receipt of payment.
9. Shipping and packaging costs must be stated on every item listing and must be reasonable amounts.
BUYER RESPONSIBILITIES
1. Upon purchasing an item through Felt, you must complete the transaction in the manner specified. By ordering an item, you state that you have the legal right to enter into and complete the transaction.
2. You must make full and prompt payment for any item you buy.
3. If you do not pay for an item ordered, Felt Ltd may suspend or terminate your account.
FEEDBACK
1. Feedback you post on Felt must not contain offensive, defamatory or inappropriate language.
2. Feedback must not contain contact details of any kind.
3. Feedback must relate to a specific sale or purchase.
FEES AND ACCOUNTS
1. Non-refundable listing fees are charged at the time of listing for the use of the Felt website as a venue. You are responsible for ensuring you are familiar with Felt’s fees before listing an item.
2. Felt Ltd reserves the right to alter any of our fees at any time.
3. If a sale is not completed, Felt may issue a refund of the listing fee or commission in the form of credit to the seller’s Felt account.
4. Your account will be suspended if you fail to pay immediately upon request fees owing to Felt Ltd.
5. Your account is used only for the payment of listing fees and sales commission. You must credit your Felt account prior to listing an item.
6. Overdrawn amounts in your account balance must be settled immediately. Felt reserves the right to take action against you to recover outstanding debts. You are liable for any expenses incurred by Felt in collection of said debt.
7. On termination of membership Felt Ltd will refund the balance of your account. If your membership is terminated by Felt Ltd for breach of our terms and conditions, refunding the balance of your account will be at the discretion of Felt.
MESSAGES
1. Message facilities on the Felt website must not be used to promote any commercial or business activity. You must not post contact details or web addresses in messages on the Felt website.
2. Felt Ltd is not responsible for any of the opinions expressed in messages posted on the Felt website. You have full legal responsibility and liability for your comments, including for offensive or defamatory statements.
3. You must not use the message facilities on the Felt website to arrange a transaction outside of the Felt website or otherwise seek to avoid sales commission on Felt.
4. Felt Ltd reserves the right to monitor messages posted on the Felt website by any member of Felt.
